Digimarc Vs. Verance Gets Sorted
5 November 2001
The U.S. Patent Office re-examination of Patent Number 5,832,119 has concluded
to confirm the validity of 75 claims for Digimarc, a leader in digital watermarking solutions
The re-examination process confirms Digimarc's original statement of patent validity raised during pending litigation between Verance and Digimarc.
Verance is charged with infringing six Digimarc patents in three separate lawsuits. Four of the patents were submitted for Patent Office re-examination; resolution of the remaining three re-examinations is expected shortly
The patent originally issued with 57 claims.
During the re-examination process, the Patent Office re-studied the validity of all 57 claims in the patent and re-approved 44 claims immediately, and further nine claims in response to Digimarc comments.
Four claims were cancelled, and 22 additional claims newly proposed by Digimarc were approved.
"We are pleased with this progress towards resolution of our pending litigation" said Bill Conwell, vice president for Intellectual Property for Digimarc.
"This Patent Office action narrows the issues left for trial and further increases our confidence in a favorable outcome. We believe that the new patent claims further strengthen our case."
